1. General Provisions

The Seller conducts sales through an online store in the territory of the Republic of Poland.
The Store operates on the Shopify platform, which provides the technical solutions for operating the store. Shopify is not a party to sales agreements concluded between the Seller and the Customer.
These terms and conditions ("Terms and Conditions") define the rules for using the online store, including placing orders, concluding and performing sales agreements, as well as the rights and obligations of the parties.
By using the Store, you accept the Terms and Conditions and the Privacy Policy. If you do not agree to these documents, please do not use the Store.
2. Definitions
Seller – Best Nature – Aleksandra Kowalczuk, data provided in point 1.
Store – the online store available at https://bestnature.pl.
Customer – a natural person, legal entity, or organizational unit making purchases in the Store.
Consumer – a natural person performing a legal act not directly related to their business or professional activity.
Entrepreneur with consumer rights – a natural person concluding a contract directly related to their business activity, when the content of the contract indicates that it is not of a professional nature for that person (Article 38a of the Consumer Rights Act).
Goods – a product offered in the Store.
Sales Agreement – a distance sales agreement for Goods concluded between the Seller and the Customer via the Store.
3. Technical Requirements and Account
To use the Store, a device with internet access and an up-to-date web browser are required.
To place an order, you may be asked to provide information necessary to fulfill the order, including contact, billing, and shipping details. You declare that the information provided is true, current, and complete.
You are responsible for the security of access to your account (if an account is created) and for any actions taken using it.
4. Products
The Seller strives to ensure that the descriptions of the Goods are accurate and up-to-date. The appearance of the Goods displayed on the screen may differ from the actual one depending on your device settings.
The Seller reserves the right to change the product range, descriptions, and prices in accordance with Section 6, provided that such changes do not affect orders placed before they are placed.
5. Placing Orders and Concluding a Contract
Placing an order constitutes an offer to conclude a Sales Contract.
The Sales Contract is concluded upon confirmation of the order by the Seller (e.g., via email).
The Seller reserves the right to refuse to process an order in justified cases, particularly if the data provided is incorrect or if payment issues occur.
6. Prices and Payments
The prices listed in the Store are gross prices, unless the Store expressly states otherwise. Shipping costs may be added to the price, which are provided during the order placement process.
Available payment methods are indicated in the Store during order placement.
The Customer undertakes to be authorized to use the selected payment method and to cover the amount due under the order.
7. Delivery
Delivery of Goods is made to the address indicated in the order.
Estimated delivery times and available delivery methods are presented in the Store. These deadlines are approximate, unless expressly stated otherwise.
The risk of accidental loss or damage to the Goods passes to the Customer upon delivery of the Goods to the Customer, and in the case of a Consumer, upon delivery of the Goods to the Consumer.
8. Withdrawal from the Contract (applies to Consumers and entrepreneurs with consumer rights)
You have the right to withdraw from a Distance Sale Contract within 14 days without giving any reason.
The withdrawal period expires 14 days from the date on which you acquired possession of the Goods or on which a third party other than the carrier and indicated by you acquired possession of the Goods.
To exercise the right of withdrawal, you must inform the Seller of your decision by means of an unequivocal statement (e.g., email or letter).
You may use the model withdrawal form, but this is not obligatory.
In the event of withdrawal from the Contract, the Seller will refund all payments received, including the costs of delivering the Goods (except for additional costs resulting from your choice of a delivery method other than the least expensive standard delivery method offered by the Seller), immediately, and in any case no later than 14 days from the date of receipt of the notice of withdrawal.
The Seller may withhold reimbursement until the Goods are received back or proof of return is provided, whichever comes first.
You must return the Goods immediately, no later than 14 days from the date of withdrawal. You will bear the direct cost of returning the Goods, unless the Store expressly states otherwise.
You are responsible for any diminished value of the Goods resulting from use other than necessary to establish the nature, characteristics, and functioning of the Goods.
9. — RELATIONSHIP WITH SHOPIFY
The Best Nature Store is powered by Shopify technology. This allows us to offer you our Services. However, all sales and purchases made in our Store are handled directly by Best Nature.
By using the Services, you agree that Shopify is not responsible for any aspect of the sale between you and Best Nature, including any injuries, damages, or losses incurred as a result of purchasing products and services.
You hereby expressly release Shopify and its affiliates from any and all liability for any claims, damages, and liabilities related to or arising from purchases and transactions made in the Best Nature store.
10. — PRIVACY POLICY
The principles of personal data processing and the use of cookies are described in the Privacy Policy available on the Store's website.
Personal data is processed in particular for the following purposes:
fulfilling orders and fulfilling the sales contract,
processing payments and delivery,
handling inquiries submitted to the Seller,
fulfilling the Seller's legal obligations.
The Store is hosted on the Shopify platform, which means that Shopify may process selected data to the extent necessary to ensure the Store's operation (e.g., infrastructure maintenance, security, and processing the purchasing process). Shopify may also process data outside the European Economic Area, while applying appropriate safeguards required by law.

11. Complaints (non-conformity of goods with the contract)
The Seller is obligated to deliver the Goods in accordance with the contract.
If you find that the Goods do not conform with the contract, you can file a complaint.
You can submit a complaint:
in writing to the Seller's address, or
electronically to the following email address: kontakt@bestnature.pl.
A complaint should include at least:
your name and surname,
contact details,
order number (if applicable),
a description of the non-conformity, and – if possible – photos or other information to facilitate the assessment of the complaint.
The Seller will respond to the complaint within 14 days of its receipt.
If the complaint is upheld, the Seller will bring the Goods into conformity with the contract through repair or replacement. If this is not possible or would require excessive costs, the Seller will apply a price reduction or refund in accordance with applicable regulations.
12. External Links and Tools
The Store may contain links to third-party websites or tools. The Seller is not responsible for the content and actions of third parties. Use of such websites is at your own risk.
13. Feedback and User Content
By providing the Seller with opinions, suggestions, or other content, you grant a non-exclusive license to use them to the extent necessary to operate the Store, present your opinions, and conduct the Store's marketing activities, while respecting personal data protection regulations.
You may not provide content that is unlawful or infringes the rights of third parties.
14. Prohibited Use
You may only use the Services in accordance with the law. In particular, you are prohibited from:
using the Store in an unlawful or malicious manner,
infringing the intellectual property rights of the Seller or third parties,
interfering with the Store's security or taking actions that destabilize its operation,
transmitting malicious software.
The Seller may block access to the Store or your account in the event of violations of the Terms and Conditions.
15. Termination
The Seller may terminate the agreement for the provision of electronic services or block access to the Services in justified cases, in particular in the event of violations of the Terms and Conditions.
Provisions that, by their nature, should apply after termination of use of the Store remain in effect.
16. Exclusion and Limitation of Liability
The information provided in the Store is for informational purposes only. The Seller endeavors to keep it up-to-date, but does not guarantee its completeness at all times.
Unless mandatory provisions of law provide otherwise, the Seller shall not be liable for interruptions in the operation of the Store resulting from technical reasons beyond the Seller's control.
The provisions of these Terms and Conditions do not limit the rights of the Consumer or the entrepreneur under the consumer rights arising from mandatory provisions of law.
17. Final Provisions, Governing Law, and Disputes
Polish law shall apply to contracts concluded through the Store.
Disputes will be resolved by the competent common courts. Consumers may use out-of-court dispute resolution and redress mechanisms, in particular:
assistance from a municipal or district consumer ombudsman,
the ODR (online dispute resolution) platform operated by the European Commission,
proceedings before the Trade Inspection Authority.
